Supreme Court Justice Anthony Kennedy has announced his retirement. President Trump responded by providing a list of 25 candidates, who have all been vetted. His standard is a highly qualified jurist that will stick to the constitution and the law. Democrats have rejected every candidate on this list without bothering to learn anything about these candidates.

Democrats will try to delay the confirmation beyond the mid-term elections. They are praying that they regain the control of the Senate and make it impossible for Trump to appoint another Supreme Court Justice. Good luck with that strategy. Following is a list of senators up for re-election:

The math is really simple. Democrats need to defend 25 seats. Republicans need to defend nine seats. Unless Democrats run the table and win every close race, odds are that Republicans will increase their majority in the Senate.

With regard to refusing to approve judges, Democrats have pulled this crap before. Republicans let Bill Clinton appoint radical leftists like Ginsburg. But when George W. Bush was elected, Democrats tried to prevent Bush was getting any judges confirmed. That only changed when a compromise was reached in 2005 by seven Democrats and seven Republicans. Most justicial appointments by Bush were grudgingly approved, but Republicans were stopped from removing the right to filibuster.

When Obama was President Republicans used the filibuster to stop some of his judicial appointments. Harry Reid went nuclear. He eliminated the filibuster. President Obama praised this decision. It seemed like a good idea at the time:

Well it sure looks like the new normal now and the Harry Reid nuclear option has blown up in Democrat’s face. Republicans can and and probably will confirm Trump’s nominee. The only real hope for Democrats is to find some serious dirt on whoever Trump chooses. If he chooses wisely they are in big trouble.

Democrats are more likely to embarrass themselves than they are to stop Trump from appointing a Supreme Court justice. Democrats may be starting a war they cannot possibly win. A war that could result in a lot of casualties in pursuit of the impossible dream. In addition, if they lose this war, they lose their base.

Democrats are missing something really important. You can’t beat somebody with nobody and whether you like him or not, Donald Trump is somebody. His name recognition is off the charts. This reminds me of when Arnold Schwarzennegger ran for Governor of California. Everyone thought he was a joke candidate, until he won. People failed to realized that Schwarzennegger was a big star. Some people liked him, some people hated him, but not one could take their eyes off him.

Donald Trump is a bigger star than Schwarzenegger. Democrats have nobody.The more Democrats attack Donald Trump, the more he looms over them. They are just embarrassing themselves in the process.

Democrats thought they had Trump on the ropes with the “save the children” crusade. Naturally the MSM went insane over the alleged mistreatment of those poor little children separated from their parents at the border. Few noticed that most of this was also done during the Bush and Obama administrations. They didn’t even notice that some of the most viral pictures were taken during the Obama administration, were taken at an anti-Trump rally or were just pure fakes.

The entire narrative was shattered by the Supreme Court. Not only was the Trump travel ban upheld, the Supreme Court verified that Donald Trump has extensive authority regarding how immigration laws are upheld.

End of conversation. This should have been a surprise to no one. On April 23, 2010 Arizona Governor Jan Brewer signed into law SB1070.

It made it a state misdemeanor crime for an illegal immigrant to be in Arizona without carrying registration documents required by federal law, authorized stated and local official’s enforcement of federal immigration laws, and penalized those found to be knowingly sheltering, hiring and transporting illegal immigrants. The Obama DOJ challenged the law as usurping the federal governments authority to regulate immigration laws and enforcement. It argued that: “The Constitution and the federal immigration laws do not permit the development of a patchwork of state and local immigration policies throughout the country. “

A Proposed Brief of Amici Curiae was filed by Michigan, Florida, Alabama, Nebraska, Pennsylvania, South Carolina, South Dakota, Texas, Virginia and the Commonwealth of the Northern Mariana Islands.

On June 25, 2012 the Supreme Court struck down three of the four provisions of S.B. 1070. That was an 8 to 0 decision with Elena Kagan recused.

The only thing stunning about this latest decision is that four Supreme Court justices ignored, for political purposes, the constitution and the decision they had made six years ago. The constitution is clear. The federal government has exclusive power regarding immigration and under the laws passed by congress that power is given to the President of the United States.

Odds are that all the lawsuits filed against Trump by all several states are doomed for failure.

Even liberal Federal Judges will hesitate to ignore a Supreme Court decision that so clearly defines the authority of the President. This is a very strong opinion and the court set the standard:

(d) On the few occasions where the Court has struck down a policy as illegitimate under rational basis scrutiny, a common thread has been that the laws at issue were “divorced from any factual context from which [the Court] could discern a relationship to legitimate state interests.

This demolished the liberal nonsense that if they “feel” the President made this decision because of personal prejudice that is enough to stop him from acting. That only applies if the decision is “divorced from any factual context from which [the Court] could discern a relationship to legitimate state interests.”

This is a complete and total victory for President Trump and every legitimate constitutional lawyer and federal judge understands that. This did a lot more than just uphold the Travel ban. It upheld the power of the President of the United States.

In addition, the opinion written by Judge Roberts strongly rejects the emotional argument by Justice Sotomayor in dissent. It is clear that Roberts is disgusted with liberal justices who are willing to ignore the constitution and previous court decisions because of personal feelings and emotions.

Shortly after writing this, the Supreme Court overturned Abood v. Detroit Bd. of Ed 431 U.S. 209 (1977 and ruled in favor of Mark Janus v. AFSCME This is a bombshell ruling that will have an immediate and devastating impact on public sector unions. Two states, New York and California, will feel the most impact. For the last 40 years, anyone who worked for a state or federal government in certain states, like California, was required to pay union dues, even if they did not want to belong to the union and totally disagreed with the politics of the union.

Here in California EVERY statewide office is currently held by people strongly supported by public sector unions. When right to work laws were passed in Wisconsin and Michigan the results were dramatic.  In Wisconsin The NEA, the teachers union, lost more than half its members. In Michigan, the NEA has lost about 21% of its teachers in the first three years.

This will bring change to California. The unions will almost immediately lose money, lots of money. Their ability to dominate every statewide election is at high risk. They will also lose members, lots of members. It will be worse here because of CalPers, which many people consider to be insolvent. There will be desperate attempts to reverse this decision, but that is unlikely to happen any time soon.  A lot of people knew that Abood vs. the Detroit Bd. of Education was wrongly decided, but it took over 40 years before this was overturned.  It is impossible to overstate the impact of this earthshattering decision.  Be prepared for loud screams of outrage by the liberal left, then the real pain begins.

Some of you may have been wondering what has happened to Democrats. This country has been dominated by two political parties for a long time. Democrats and Republicans frequently disagree on almost every issue. That is not new. But they still could be friends, they could work together, socialize together, go to church together. One might disagree with someone without considering them to be disagreeable.

That has obviously changed and now Democrats seem to view anyone who disagrees with them to be pure evil. I recently discovered a document that explains a lot of what is happening. It is an oath taken secretly by liberal Democrats:

No one seems to notice that Lennon is not describing  paradise he is describing chaos where evil rules and the brotherhood of man is blurred by the stench of institutional poverty. World War II could have easily been avoided as long as one didn’t mind Adolph Hitler in charge.

Most of us are familiar with the two minute warning in the NFL. Both teams are warned that there are only two minutes left in the half. Obviously in the second half, this means there are only two minutes left in the game. In reality this is nothing more than a gimmick designed to allow one last chance for advertising. I doubt that many NFL coaches are “surprised” by the two minute warning.

I have now come up with my five minute warning. Let me put this in perspective. I used to commute to and from San Francisco every day. Michael Savage was always on the radio for the ride home. He was always entertaining but he also always said something incredibly stupid and insulting. I used to time my commute by how long it took for Savage to say something so outrageous that I would turn him off. It was as predictable as rain, which in Northern California is pretty easy.  If it is between April and November it never rains. If it is between December and March, it always rains. But, I digress.

My new “five minute warning” is regarding CNN. I used to watch CNN on occasion if for no other reason than to hear the most biased possible version of any news story. It was kind of a “know your enemies” moment. However ever since Trump was elected, CNN has gotten progressively (pun intended) worse. It seems to start each day on a mission to find a way to trash Donald Trump as often and as loud as possible. CNN simply cannot report on any story, any time, without resorting to trashing Trump. Hence the five minute warning. If you accidentally tune in to CNN, you have a maximum of five minutes before they will start trashing Trump again.

It doesn’t matter what the story is about. Last night I changed the channel to CNN because Fox was running a non-stop tribute to Charles Krauthammer. While I really liked Krauthammer at some point this was becoming repetitive. So I stupidly checked out CNN. They were reporting on steps North Korea was taking to disarm its’ nuclear arsenal. Miraculously they found a way to spin this as negative about Donald Trump. Unbelievable! Shouldn’t we all want to believe that North Korea is actually keeping its part of the deal? Granted this upsets CNN, because they can’t bear the thought of Trump getting credit for anything, but come on. Any hint of progress in North Korea dismantling its nukes is a good thing, regardless of who gets credit. If you doubt that, just ask the people on Hawaii who thought they were going to get nuked not that long ago.

I thought back about the last few times I stupidly tuned into CNN. I cannot recall a single instance where they went more than five minutes before they trashed Donald Trump. Hence the five minute warning. It has been a long time since I considered CNN a credible news source on any subject. But in the past, they did at least sneak in a few legitimate items from time to time. That has now changed. They don’t even try anymore. If your stomach will take it and you are a glutton for punishment here’s the challenge. Tune in to CNN, any time of day or night, then starting timing. You will quickly see why the five minute warning is so necessary. (Please don’t buy anything from companies who advertize on CNN, because people dumb enough to advertise on CNN are unlikely to  produce smart products.)

One thing that should have sent shock waves through the media is the fact that Horowitz admitted that he was investigating whether or not the obvious bias by Peter Strzok impacted the decision to start the Russian collusion investigation:

House Judiciary Committee Chairman Bob Goodlatte, R-Va., questioned Horowitz on whether that apparent bias influenced the initiation of the investigation into Russia interference in the 2016 campaign and potential collusion with Trump’s team. 

“That’s a matter we’ve got under review and are looking at right now,” Horowitz said.”

Peter Strzok was front and center of both the Hillary e-mail investigation and the Russia collusion investigation. His text messages are a case study in bias. Horowitz sees this as well, which is why this is being investigated. This is beyond serious. Once could argue that the entire Russia collusion investigation and the subsequent Mueller investigation was the fruit of the poisonous tree. This is why the FBI was so desperate to fabricate a good reason to spy on a Presidential campaign. It is why they tried to pretend the discredited Russia Dossier was an insignificant factor in obtaining a FISA warrant on Carter Page. So far, all of the theories for why the FBI started this investigation are falling apart under scrutiny. We are left with Peter Strzok.  The same Peter Strzok who was promising his mistress he would stop Donald Trump from becoming President.

Many assume the FBI was covering this up because they didn’t want the embarrassment. The FBI said it didn’t want to release these documents because it might impact an ongoing criminal investigation. Both could be true. If an altered 302 was used in a criminal case, that could have a negative impact on a lot of unrelated criminal cases were a 302 document was crucial to the prosecution. In any event the Republicans finally put enough pressure on the FBI to get these documents produced. This may be an even bigger story than anyone realizes.

STATEN ISLAND

Most of us remember Eric Garner. Fewer know that the police involved were acquitted of any crime. Very few paid any attention to what happened to the neighborhood because of kinder gentler police tactics.  The people who should be concerned about this development are not white Americans.  We tend to live in nice, clean suburban communities.  Notice in this case that the white people still living there are making plans to leave.  That is often because they have a choice.

The results will be devastating, for honest black citizens. Even liberals will quickly decide to avoid any place where black people live, work or play. It won’t be obvious at first, but the results will be there for anyone paying attention. Black neighborhoods will become increasingly black. White neighborhoods will become increasingly white. There will be fewer police, of any color, willing to work in black neighborhoods and black on black crime will skyrocket. There will be no shortage of cops, of any color, willing to work in white neighborhoods, where they are welcomed, even by liberals. Rich white liberals will move into safe enclaves where they can put up fences, road blocks and hire private security to keep the undesirables away. That security, by the way, will be armed.

I would suggest watching the documentary series called “Flint.” This is a city with more than its’ share of problems where good people, black and white, got together and worked together on a solution.  For the record this was done by a black female major working with a black police chief. They worked together to enforce the rule of law and arrest criminals, without regard to race. They didn’t spend a lot of money on new police officers, new training, new equipment etc., primarily because they didn’t have any money. Instead they took the existing staff and gave them a directive to stop just responding to crimes that have been committed. Instead go out there find and arrest criminals. It is transforming Flint.

Watch the episode where police respond to the assassination of white cops in Dallas. Watch how they respond to the shooting in Minnesota and how is was portrayed by the media and groups like Black Lives Matter. The dialog by both the black and white police officers is raw and honest. They have very different views on race relations in this country, but both are united in the importance of focusing on arresting criminals.

It is quite simple. When you have good leaders, you end up with Flint. When liberals remain in power, you get Staten Island.  The color of their skin is irrelevant.

If you listen to the main stream media, you know that Donald Trump changed U.S. immigration policy to authorize ICE to physically separate children from their parents. This bitter, cruel and heartless man has no regard for human rights. He is putting people in concentration camps, for political purposes. He is frequently compared with Adolph Hitler. People are outraged. They are writing him scathing letters and demanding action. Who could blame them. How can we tolerate such behavior?

The only thing missing in this narrative are some very real, but inconvenient facts. Our immigration laws are a mess. Whether this was done deliberately or just through incompetence is somewhat irrelevant. What is relevant is that Donald Trump, like any other President, is confronted with only bad options.

Before you judge President Trump, please take a moment to learn the facts. Thousands of people are flooding to our borders. No one can blame them. They are trying to escape countries with systemic poverty and the United States is a far better alternative, even if one must get here illegally. Recent news broadcasts, shown around the world are telling people how to game the system. If you show up at our border, ask for asylum, you will be allowed to enter. You will be given a slip of paper saying you need to come back for a hearing on your legal status. You then just walk away. Very few people bother to show up for that hearing. Why would they? Irresponsible media reports are encouraging people to take long and dangerous trips by promising them they can just walk across the border into the promised land.

Many, but not all the adults showing up with children at the border are real families. History has taught us that evil people are more than willing to exploit children. For example; It is routine for terrorists to use children as human shields.

This means if we just follow the existing system and allow any adult showing up with children to walk into the country at least some of those children will be exploited. Some of them will be victims of sex trafficking. Sometimes the “children” aren’t even related to the adults, they may even be MS13 members.

There are approximately 12,000 children in U.S. protective custody. The majority, 10,000 of them, showed up at the border with no parents. They were abandoned by their parents and sent unaccompanied to the border.

There are approximately 2,000 children who did arrive here with adults claiming to be part of a family. The proper process for claiming asylum is to do so in Mexico. No family is separated if they follow the rules. Instead, people enter the U.S. illegally and then claim asylum. A high percentage of people claiming asylum are lying. ICE reports that 80% of asylum claims are bogus. I know of no one who disputes that fact, they just ignore it.

While adults can be charged with a crime for entering the U.S. illegally that law does not apply to children. That is why 10,000 kids were sent to the border by themselves. This also means that even if adults enter the country illegally, if they have children with them after 20 days either the entire family must be set free or the children must be separated from the parents and put in protective custody. If family members legally residing in the United States can be found, the kids are given to them. They are given medical care, food and clothing and they attend school. This is a far cry from the cages used by the Obama administration. Yet the media ignored that when Obama was President and would like you to believe these are concentration camps. There is a constant problem with resources because that also requires congressional approval, which is resisted by the same people who are trashing Trump.

Trump was faced with two bad options. He could continue to basically allow anyone to just walk into the country, if they had some kids in tow or he could enforce the law resulting in some children being separated by their parents.

He chose to enforce the law and then he went to congress and pleaded with them to change the law. The same people shrieking with outrage at Donald Trump will not consider changing the law because they want this crisis. They need this crisis. They think this crisis will help them gain political power. They couldn’t care less about the impact on those children. They want heart wrenching videos of children weeping as their parents are led away. This plays right into their narrative. At a minimum they want this crisis to continue through the midterm elections.

Sometimes a President must make very difficult decisions. Winston Churchill ordered thousands of men to fight the Germans, when there was no hope of victory and no attempt at rescue so that Britain could try to rescue thousands of other men stranded at Dunkirk. Someone needs to make those kinds of decisions. If your child is held hostage by terrorists, you would probably be willing to do anything to get them back. But a President knows that if we give in to terrorists the result will be more hostages. This does not mean he hates the hostage and doesn’t care what happens to them, it just means his duty to the country may trump his personal compassion.

Every President is faced with impossible decisions. The job is made even more difficult when public outrage based on incomplete facts is added to the mix. We should all be concerned over the tragedy of people living their lives in unspeakable poverty. However, we should also learn from the mistakes of others. Europe is paying a terrible price for showing compassion to refugees and opening borders to anyone who showed up. What started out as an act of human compassion resulted in a nightmare.

The fact is we need to secure our border. We should set up the fairest possible system for letting people from other countries come here. But the most unfair system of all is letting those people who game the system get the advantage. That is unfair to those who played by the rules and came here legally. It is unfair to those who would like to come here now but can’t because they are crowded out by those who have no interest in playing by the rules.

One may or may not agree with the decisions made by Donald Trump. You may hate his personality. But if you disagree, then please combine your disagreement with an option for another strategy that will solve the problem. Merely screaming at him and pretending he is some horrible monster is not a solution. It is rather part of the problem.

There are reports that Peter Strzok was escorted off FBI headquarters today. The response from his attorney is amazing:

“All of this seriously calls into question the impartiality of the disciplinary process, which now appears tainted by political influence,” a statement from Goelman said.

He said that Strzok “has complied with every FBI procedure, including being escorted from the building as part of the ongoing internal proceedings.” The attorney did not say exactly when Strzok was escorted out.

“Instead of publicly calling for a long-serving FBI agent to be summarily fired, politicians should allow the disciplinary process to play out free from political pressure,” Goelman said. “Our leaders and the public should be very concerned with how readily such influence has been allowed to undermine due process and the legal protections owed to someone who has served his country for so long. Pete Strzok and the American people deserve better.”

Either Goelman has either never read the texts from his client or he is a complete idiot. This reminds me of the definition of “Chutzpah” I got from a Jewish friend. He said: “it is like the guy who murdered his parents and then threw himself on the mercy of the court because he was an orphan.”

That guy probably has a better chance than Peter Strzok.

The IG report has been released and it is worse than expected.  After the murder of the Jewish athletes in Munich during the Olympics, Jim McKay said that:

When I was a kid my father used to say “Our greatest hopes and our worst fears are seldom realized.”Our worst fears have been realized tonight.

The problem is not that the FBI colluded with the DNC to try and influence a Presidential election. It is not that the FBI hated Donald Trump so much that it started a Russian collusion investigation based on zero facts.  It is not the fact that the liberal left has spent the last eighteen months trying to overturn the results of an election. It is not that Hillary Clinton is likely to escape the consequences of her criminal negligence with regard to the use of her personal e-mail server. It is not even that the Obama administration used the intelligence community to spy on a political campaign during an election. All of these things are true. They are all documented by the facts in the IG report. All of these things are serious problems. But they are not “the” problem.

The “problem” is that Democrats are so full of hatred for Donald Trump that they do not care. They still view this through purely partisan eyes, oblivious to the danger to our democracy.  I cannot speak for other conservatives or Republicans, but I would be just as concerned and outraged if these actions had been done by conservatives and Republicans in an attempt to stop Hillary Clinton or Barack Obama. I would be equally concerned even though I consider Barack Obama to be one of the worst Presidents in history. I would be equally concerned even though I consider Hillary Clinton to be hopelessly corrupt and incompetent. I would be concerned because the miracle of our democracy is our constitution with the separation of powers, the rule of law and the peaceful transfer of power, even when we hate the results of an election.

It is clear that the leaders of the Democratic Party no longer believe this. Neither do their nodding heads in the main stream media. What is desperately needed at this juncture, is one strong Democrat ready, willing and able to stand up for truth, justice and the American way. Instead Democrats dream of Barack Obama, who let this happen on his watch, returning to save the day. The sad reality is that there are no leaders in the Democratic Party today who seem remotely capable of this kind of leadership. I can’t even identify a leader in the Democratic Party who recognizes there is a problem. It is a sad day.

This IG report has legs. The real jury is the American people and they are going to be stunned by the facts. No amount of spin by the liberal left can change the underlying facts. It is impossible to read this report and believe that the FBI was not hopelessly biased with regard to the Clinton investigation and the Trump campaign. It is also impossible to read this and retain even a shred of respect for the integrity of the main stream media. Those days are gone.

These facts can no longer be slow walked and obstructed by the current FBI leadership. They cannot be spun away by the MSM.  If anything, we are likely to discover more facts even more disturbing. The real question is the verdict of the American people. We should learn that in the near future.
