{"id":2777,"date":"2014-07-14T17:17:17","date_gmt":"2014-07-15T00:17:17","guid":{"rendered":"https:\/\/scotshonor.com\/?p=2777"},"modified":"2014-07-14T17:17:17","modified_gmt":"2014-07-15T00:17:17","slug":"the-calm-before-the-storm","status":"publish","type":"post","link":"https:\/\/scotshonor.com\/?p=2777","title":{"rendered":"THE CALM BEFORE THE STORM"},"content":{"rendered":"<p>I used to handle the tort litigation nationwide for a major corporation.\u00a0 I remember one particular claim where the local representatives worked with senior management to investigate a claim before they turned it over to my department.\u00a0 I was presented with a book, about 5 inches think.\u00a0 It was very entertaining, with a cast of characters right out of the <strong>\u201cGodfather.\u201d<\/strong>\u00a0 But the problem was that in spite of the volume of speculation there were very few documented facts.\u00a0 I had to start over and re-investigate the claim from day one.\u00a0 Even where they basically got the story right, they have fallen far short of the standard of documentation necessary to prove up the file.<\/p>\n<p>I believe this is very similar to the Benghazi file inherited by Trey Gowdy.\u00a0 He has a lot of e-mails, and colorful testimony before congressional committees.\u00a0 But he is a long way from having a properly documented investigation.\u00a0 That is why you haven\u2019t heard from him for a while.\u00a0 His people are going back to square one.\u00a0 They are reading the source documents and probably interviewing people.\u00a0 He will save the public testimony for things that really matter.\u00a0 When someone is called before this committee they better be prepared, because Trey Gowdy will be prepared.\u00a0 There will be no repeat of the silly season where Democrats don\u2019t ask any questions at all and Republicans ask <strong><em>\u201chave you stopped beating your wife yet\u201d <\/em><\/strong>gottcha questions.\u00a0 Neither is the least bit effective at getting to the facts.<\/p>\n<p>One of the things I quickly learned was to pay attention to the details.\u00a0 Sometimes an investigator will ask a question that seems to be irrelevant to the subject at hand, but it is extremely relevant to the credibility of the witness.\u00a0 I can give an example.\u00a0 We had a plaintiff that was a well-known highly-decorated Vietnam Veteran.\u00a0 However, when I read his deposition it was obvious to me that he had never actually served in Vietnam.\u00a0 He was using terminology that no real Vietnam Veteran would ever use.\u00a0 So I contacted my attorneys and told them of my suspicions.\u00a0 They were shocked, because this guy was a local celebrity and was on TV all the time.\u00a0 Reluctantly, they did investigate and quickly discovered that this guy was a fraud.\u00a0 He had not only never served in a combat position; he had never even been to Vietnam.<\/p>\n<p>A trained investigator is a very dangerous person.\u00a0\u00a0 It is nothing like what you see on TV where some tough good guy intimidates criminals into confessing all.\u00a0 \u00a0In real life that rarely works.\u00a0 The good investigator focuses on the details.\u00a0 It is quite simple.\u00a0 People who are lying almost always get some of the seemingly minor details wrong.\u00a0 Those who are just telling the truth don\u2019t have that problem.\u00a0 Trey Gowdy is starting the process by double checking the details.\u00a0 That makes him and his committee very dangerous.\u00a0 I believe he will expose the truth on Benghazi.\u00a0 If the truth is as bad as some of us suspect, then we are experiencing the calm before the storm.<\/p>\n<p>TDM<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I used to handle the tort litigation nationwide for a major corporation.\u00a0 I remember one particular claim where the local representatives worked with senior management to investigate a claim before they turned it over to my department.\u00a0 I was presented &hellip;
