In the common law of torts, res ipsa loquitur (Latin for “the thing speaks for itself”) is a doctrine that infers negligence from the very nature of an accident or injury in the absence of direct evidence on how any defendant behaved. Although modern formulations differ by jurisdiction, common law originally stated that the accident must satisfy the necessary elements of negligence: duty, breach of duty, causation, and injury. In res ipsa loquitur, the elements of duty of care, breach and causation are inferred from an injury that does not ordinarily occur without negligence:

What we currently know:

Devin Nunes wrote a four page memo summarizing the findings by Republicans on the House Intelligence Committee regarding alleged abuse of FISA warrants.  For months Republicans met, without any Democratic participation, because they clearly do not trust Democrats on the committee, particularly Adam Schiff.

Adam Schiff sued to prevent his own committee from getting access to the documents.  Now he is trying to prevent disclose of the memo.  He is also allegedly writing his own version of events.

This memo has been made available to every member of the House, in a secure facility.  Nearly every Republican has viewed this memo.  Only have handful of Democrats have bothered. Almost everyone who has actually seen the document has described it as shocking and jaw dropping.

There are numerous reports that at 5:00 p.m. today the House Intelligence Committee will vote to release this memo.  President Trump is not expected to resist release of this memo.

Yesterday, FBI Director Christopher Wray viewed this document in a secure facility on Capitol Hill.  He was asked if any of the information was incorrect.  Wray said he would want this reviewed by the FBI, but he did not point out any obvious errors.

Today, Deputy FBI Director Andrew McCabe resigned effective immediately and left FBI headquarters.  He will use his vacation day to get paid up until March, so he can retire with full benefits.  Is this a coincidence?

The main stream media that wants to believe McCabe, who is as pure as the driven snow, resigned because Trump said mean things about him on twitter.

Every single senior FBI official serving under James Comey when he was fired has now been removed from power.  CNN wondered if this was because of pressure from Trump, ignoring the fact that these people were removed because of conflicts of interest documented in their own e-mails and text messages.
